Payment: a. Full package payment to be received in full by the booking vendor managing couple, managing vendor to transfer funds to celebrant into nominated bank account on behalf of couple. REFUND POLICYa) Couples booking fee/ retainer is non-refundable after securing date and time of ceremony and agreement has been signed.b) Booking fee is not refundable should government restrictions occur due to the COVID-19 crisis.c) Fees are only refundable at the discretion of the celebrant.d) No refund will be offered if the celebrant has to leave on the day of the ceremony if the couple are more than 30 minutes later than the intended start time. Please note if the celebrant is able to return at a later time extra fees will be incurred. 2. The agreed starting time will not change without prior consultation and approval with the celebrant. If time is unsuitable and the celebrant has other commitments at the new time, the booking fee is forfeited and the NOIM will be transferred to another celebrant. 3. In the event the celebrant is unable to attend your ceremony due to illness, accident or other circumstances outside my control every effort will be made to find a replacement celebrant. The celebrant will cover the fees of the replacement celebrant provided you have paid your account in full. We understand this will mean it is necessary (by law) for us to show birth certificates and photo ID or passports as well as death/divorce certificates if relevant, to the replacement celebrant. 4. The celebrant will arrive at the ceremony location at least 30 minutes before the agreed starting time. Should you require, please ensure a signing table has been pre-organised as this is not a service inclusion. 5. The couple are to seek appropriate council approvals / permits for public places. Permit must be sent to celebrant 2 weeks prior to ceremony for her records. 6. In the event the commencement of the ceremony is delayed by more than 30 minutes beyond the agreed starting time, the celebrant has the right to leave for another engagement and return at a time convenient to her if the ceremony has not commenced within 30 minutes of the agreed starting time. Additional fees may be incurred.7. The ceremony will not proceed if the celebrant has not sighted and signed all legally required documents prior to the ceremony or, if in the celebrant’s opinion, either of the parties or their witnesses is not in a position to fully understand the legal obligations of the marriage ceremony. 8. The Celebrant reserves the right to postpone/move the ceremony if she deems it unsafe to proceed. (heat, rain, wind etc) 9. In the event of unforeseen extreme / bad weather (rain, wind, storms etc) one of the parties must contact celebrant no later than 2 hours prior to ceremony with contingency plans. If the ceremony is delayed by more than 30 minutes beyond the agreed starting time, the celebrant has the right to leave for another engagement and return at a time convenient to her if the ceremony has not commenced within 30 minutes of the agreed starting time. Additional fees may be incurred. 10. If required, PA system will not be available in the event of bad weather (rain, wind, storm and/ or where there is a chance of bad weather risking the safety of celebrant, guests and the public. 11. The client is to provide correct and accurate information regarding their identification and eligibility to marry along with their wishes for the ceremony. As a legal requirement, all couples will be asked to complete ‘Declaration of no legal impediment to marriage form’ prior to ceremony. 12. Date for final approval of the ceremony script format to be adhered to, allowing for preparations to be undertaken. Any requested changes after final approval of script cannot be guaranteed. Celebrant has the right to refuse request should time not permit. Additional fees may be incurred. 13. Couple is to adhere to social distancing and government regulations in regards to the number of guests at ceremony and any other requirements the celebrant is to put in place to legally abide with regulations set by the attorney generals department, state and government agencies. 14. PAYMENTS – PRE WEDDING/BOOKING We agree to pay a non refundable & non transferable booking fee of $300 payable on execution of this agreement. We further agree that payment of the initial booking fee serves to confirm our nominated wedding date as per the details shown in the front of this order.(a) We agree to pay the full balance of our chosen collection prior to or on the Wedding Day. Upon failure to do so Jensen & Co. reserves the right to refuse to carry out Cinematography services as agreed.(b) The booking of locations, ordering of products, travel and lodgement costs related to the wedding are our responsibility and are required to be paid for at the time those costs are incurred and are in addition to the total cost of our agreed cinematography collection. CANCELLATIONS/ALTERATIONS We agree that if we decide to alter our wedding plans we must notify Jensen & Co. promptly and in writing as soon as the alterations have been decided upon. Furthermore we agree that if we choose to cancel our wedding in full for any reason we must notify Jensen & Co. promptly and in writing as soon as the decision to cancel has been made. If cancellation occurs less than 12 weeks before the nominated wedding date, full payment for the services agreed to herein including all related costs will be required within 14 days of the cancellation. If cancellation occurs more than 12 weeks before the nominated wedding date the booking fee will be forfeited and any additional related expenses incurred by Jensen & Co. in preparation for the wedding will be required to be paid in full within 14 days of the cancellation. Jensen & Co. may allow a claim towards other cinematography by them within twelve (12) months of the date of this order. PRE WEDDING We are satisfied that the details overleaf are correct and will confirm the details prior to the Wedding. We agree to advise the hairdressers and make-up artists, the hire cars and the caterers of all the relevant times, details and locations as detailed here and tocoordinate their services.(a) The details & times listed form part of this agreement and we agree to make every effort to cooperate in order for Jensen & Co. to fulfil their contracted cinematography duty. We acknowledge Jensen & Co. cannot accept responsibility for the ‘extent’ of the coverage if these details are incorrect or if we choose not to follow the agreed to schedule. Given the unpredictable nature of weddings Jensen & Co. can make no guarantees regarding the delivery of any specific film vision, although all reasonable effort will be made.(b) We accept the responsibility to contact Jensen & Co., at least two weeks prior to Wedding, to confirm details are correct and are no alterations. WEDDING DAY To avoid disruption to the cinematography coverage and to Jensen & Co. to fulfil their contracted duty, other video by family and friends will be at the discretion of Jensen & Co.(a) We agree that Jensen & Co. will be the ONLY entity commissioned to provide wedding cinematography on the specified date.We agree to ensure this clause is explicitly communicated to other suppliers and press employed or present on the day.(b) If the Cinematographers are on site for 6 plus hours, a meal should be provided by the Bride and Groom.(c) Jensen & Co. reserves the right to terminate or suspend coverage and leave the location of the wedding if they or any member of Jensen & Co’s staff experience inappropriate, threatening, hostile or offensive behaviour from any person/s at the wedding or inthe event that the safety of the cinematographer is in question.(d) Jensen & Co. is limited by the guidelines of ceremony officiant or venue manager: ie – Priest, reception venue manager. We agree to accept the technical results of their imposition on any restrictions. POST WEDDING We understand that Jensen & Co. has full discretion over the footage released to us and only footage deemed acceptable quality will be released to us. Completion of the above released images/footage will be 4-5 weeks from the date of the contracted wedding and may extend during periods of high volume or recognised holiday periods. Under no circumstances will unedited RAW footage will be released.(a) A USB of high res JPEG files/high quality edited footage is provided as part of all services and the footage contained may be uploaded and displayed online for personal use only. Digital files may not be altered with cropping or filters at anytime.(b) We agree the copyright in all film is owned by Jensen & Co. We give permission to Jensen & Co. to use general non personal footage of our Wedding for industry competitions and as required subsequent usage and for reasonable general promotional advertising for Jensen & Co. The images supplied by Jensen & Co. are for personal usage only, the usage for any other purpose is to be renegotiated between the parties and requires specific permission.(c) The digital proof footage remain the property of Jensen & Co. and will be kept on file a period of two years. We recognise that materials & technology change constantly so it is our sole responsibility to protect and retain our film in their digital forms for thefuture. We note that shared ownership of our film will be granted once the contracted duties of Jensen & Co. have been fulfilled & we the client have paid in full for our chosen film collection.(d) The wedding will be considered one order, regardless of how many individual parties request products. We will be responsible for the entire order and no partial orders will be given out until the balance of the order is paid. (f) All orders must be accompanied by full payment unless prior arrangement with Jensen & Co. has been made. (g) Should we fail to inform Jensen & Co. of any alterations within (2) weeks of receipt of our digital film we understand that Jensen & Co. will mark the film as complete & accepted by us and produce any copies relevant to our chosen collection. Additional changes after this time will incur an hourly edit fee of $175 inc gst. (h) All orders shall remain the property of Jensen & Co. until full payment has been made. We acknowledge that no future orders will be processed until the order is paid in full. (i) Only Jensen & Co. is authorised to supply or distribute digital files/film to suppliers from the wedding, blogs or competitions unless specific permission has been granted by Jensen & Co. or their authorised representative. SAFETY & RETENTION OF DELIVERED FILES Jensen & Co. has no control over the environment in which your digital film is kept once delivered to you and that USB’s, and other common storage devices have limited life expectancy and are warranted for a period of two (2) years from the date of delivery. ELECTRONIC CONTENT We understand and agree that we are solely responsible for all copyright obligations pertaining to any electronic content and music files we provide to Jensen & Co. for the purposes of inclusion in our order. We agree that we have purchased the electronic content and music files lawfully and we warrant and confirm that we either own the copyright to or have appropriate permission to use any electronic content and music files. We agree to defend, indemnify and hold Jensen & Co. and their employees and affiliates, harmless from any suit, demand, or claim arising out of any breach of this warranty. JENSEN & CO. Should Jensen & Co. not be available for any reason, they will notify the bride & groom of the change as soon as it is known and make all possible effort to provide another cinematographer with equivalent skills or provide a refund, whichever is the client’s choice. As the cinematography shot by Jensen & Co. is done so with the finest materials & equipment currently available Jensen & Co. unconditionally guarantees them. If in your opinion any USB made by Jensen & Co. has lost its original functionality, Jensen & Co. will replace the item free of charge after they has tested the item and found it to be not functioning correctly. The faulty item must be returned to Jensen & Co. for testing. This warranty will be valid for as long as Jensen & Co. has in their possession the original archived files/footage in suitable condition. Jensen & Co. shall carry out this assignment with due and professional diligence. Elements beyond Jensen & Co’s. control include faulty material, equipment failure, loss of digital files/footage in transit between the studio and professional laboratories employed by Jensen & Co, loss or damage to digital files/footage during processing, developing and editing either by Jensen & Co. or professional laboratories employed by Jensen & Co, industrial disputes, civil disturbances, weather conditions, Epidemics or Pandemics which may inhibit or prevent Jensen & Co. completing in whole or in part this assignment. In this case Jensen & Co. shall not be liable for their complete performance of the assignment.It is agreed that the liability of Jensen & Co. shall be limited to a total of and not exceeding the total amount of monies paid under the terms of this agreement which shall be in full & final satisfaction of any damage or loss suffered.(a) In the case of a Pandemic or Epidemic that results in governmental restrictions and rescheduling of events, Jensen & Co. will offer a reschedule at no extra fee. If Jensen & Co. cannot attend the re-scheduled date and it is outside of 6 weeks of the new date, all monies paid except the booking fee will be reimbursed. NATURALLY JEK PHOTOGRAPHY SERVICE/WEDDING CONTRACT CONTACTNaturally Jek PhotographyJekkaPh: 0458 400 979naturallyjek@gmail.comhttp://www.naturallyjek.com TERMS AND CONDITIONS Naturally Jek Photography and the Client hereby acknowledge that the following standard terms and conditions are incorporated into, and form part of, the Contract between the parties hereto. 1. ENGAGEMENT AND SERVICE This Contract is between Naturally Jek Photography and the Bride and Groom named above (“the Client”) . The Client wishes to engage Naturally Jek Photography and Naturally Jek Photography accepts the engagement to hereby: (a) provide the services to the Client; and (b) produce digital photographs supplied on USB and online gallery (available for twelve (12) months following delivery). 2. CONTRACT AND PAYMENT ARRANGEMENTS As Naturally Jek Photography is often booked up to two (2) years in advance, the following is required to secure a Client booking: An electronically signed Elopement Photography Contract and acceptance of the Terms and Conditions; andPayment of the non-refundable booking fee of $700 AUD. The fee for the package agreed to is the minimum amount that the Client is agreeing to for Naturally Jek Photography services. The Client may upgrade the package to include additional services at any time, however, the Client cannot downgrade the package to a smaller package or reduced services which would result in a reduced fee. The Client agrees to pay the fee to Naturally Jek Photography. All amounts payable under this Contract are inclusive of GST. All additional costs such as permits to photograph in national parks or on beaches that require permits, if any, are the responsibility of, and must be paid for by, the Client. Final payment is required no later than one (1) month prior to the wedding date. The hours of service provided in each package are continuous. 3. UPDATED TERMS AND CONDITIONS These Terms and Conditions are subject to change and may be updated at any time by Naturally Jek Photography at its sole discretion by providing notice to the Client via email and the Client’s acceptance of the updated Terms and Conditions. By continuing to use Naturally Jek Photography services after receiving notice of the updated Terms and Conditions the Client agrees to the updated Terms and Conditions. 4. PRE-EVENT CONSULT The parties agree to a pre-event consultation before the wedding date via Facetime or other electronic messaging, telephone or in person, in order to finalise the actual shooting times and locations. This will occur on, or at least, two (2) weeks prior to the wedding date. In the case of a pre-event consultation being rescheduled, a minimum of 2 weeks notice must be given to avoid a reschedule fee being applied. In the case of not showing up to the planned consultation a $100 fee is applied to schedule in a new time. If a second consultation is required due to couples request in the event of location changes or other event, a $60 consultation fee applies plus travel fees where applicable, quoted at the time of appointment. A 15 minute grace period is given for each consultation. After this time, the consultation will be considered a reschedule due to limited time slots available and subsequent appointments following the booked consultation period. 5. CANCELLATION Should the Client wish to cancel this Contract at any time, a Notice of Cancellation must be given in writing to Naturally Jek Photography as soon as possible. Under any circumstances after booking, if a cancellation occurs, Naturally Jek Photography will retain the non-refundable booking fee paid of $700 AUD booking Fee. If the Contract is terminated within six (6) months of the wedding date and before the final payment has been made, the Client agrees to pay the final payment to Naturally Jek Photography if required by Naturally Jek Photography in the circumstances, such as in the event that Naturally Jek Photography is unable to secure another booking for the cancelled wedding date. Whether or not the final payment is required will be at the sole discretion of Naturally Jek Photography. Should Naturally Jek Photography require the final payment to be paid by the Client then Naturally Jek Photography shall provide written notice to the Client. The Client agrees to pay the final payment to Naturally Jek Photography within seven (7) days of receiving such notice. If the Contract is terminated after the final payment has been made, Naturally Jek Photography shall retain all amounts paid under this Contract and the Client agrees that no refund will be provided. 6. RESCHEDULING Should the Client wish to reschedule the wedding date at any time, a Notice of Postponement must be given in writing to Naturally Jek Photography and Naturally Jek Photography must provide written acknowledgement that such notice was received before the notice is effective. Under any circumstances after booking, if a rescheduling occurs more than six (6) months prior to the wedding date, Naturally Jek Photography will retain a rescheduling booking fee of $440 (equal to the price of their cheapest package to compensate for the original date being held and work not taken). If a rescheduling occurs within six (6) months of the wedding date, Naturally Jek Photography will retain a rescheduling fee of $500. The rescheduled wedding date must be within twelve (12) months of the original wedding date and is subject to the availability of Naturally Jek Photography. If a suitable rescheduled wedding date is not available within twelve (12) months of the original wedding date the rescheduling will be considered to be cancellation and will be processed accordingly pursuant to clause 5 above. The rescheduling fee must be paid at the time of rescheduling. 7. SCHEDULES Naturally Jek Photography will provide a schedule for the time that the Client has booked. Naturally Jek Photography will not be held responsible for any lack of photographs delivered due to unknown changes or omissions. 8. LIMITATIONS OF SERVICE Please note that Naturally Jek Photography is governed by the restrictions imposed by churches, outdoor elopement style locations and other venues. In some cases, venues restrict the movement of photographers, the use of flash, or in extreme cases, prevent the taking of photographs at all. It is the responsibility of the Client to make the necessary enquiries regarding possible restrictions and inform Naturally Jek Photography prior to the wedding date. Naturally Jek Photography will not be held responsible for any lack of photographs delivered due to such restrictions. 9. EXCLUSIVITY/GUEST PHOTOGRAPHY It is understood and agreed that Naturally Jek Photography will act as the sole and exclusive wedding photographer. Because flashes from guests’ cameras may adversely affect shots taken by Naturally Jek Photography, the Client acknowledges that the Client is responsible for notifying all of their guests that guest photography using flash is restricted at any time while the professional photographer is in session. The formal photography time is for the exclusive use of Naturally Jek Photography to capture the formal wedding portraits. Because of time constraints and the need for subjects to pay full attention to the professional photographer, guest photography during formal photography time cannot be permitted. Naturally Jek Photography agrees to guests taking snapshots during the pre and post professional sessions. If mobile phones are visible in the images, it is not Naturally Jek Photography’s responsibility to manage guest behaviour nor edit the mobiles from the images. 10. COVERAGE Every effort will be made to capture as many moments of the wedding day as practically possible, however it is not possible to capture absolutely everything. If the Client has suggestions or desires for photos to be captured, such as a surprise dance down the aisle or specific family photos, Naturally Jek Photography requests that the Client provides Naturally Jek Photography with a list and Naturally Jek Photography will do its best to capture them. Because of the ever-changing nature of wedding days, not everything can be covered. Naturally Jek Photography is not responsible for a missing family member(s) during the family photo session nor promises to deliver certain images/poses, however Naturally Jek Photography will do their uttermost to satisfy the Client. 12. GUEST COOPERATION The Client is responsible for the conduct of their guests. Naturally Jek Photography will not tolerate abusive, inappropriate, threatening, hostile or offensive behaviour from anyone at the service. If the Client is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer, it will result in the early or immediate departure of the photographer. If Naturally Jek Photography leaves the service in accordance with this clause, Naturally Jek Photography will not be liable to refund any amount to the Client, but may provide the Client with photographs taken by Naturally Jek Photography prior to Naturally Jek Photography leaving the service. 13. SAFETY Naturally Jek Photography reserves the right to terminate coverage and leave the location of the service in the event that the safety of the photographer is in question. If Naturally Jek Photography leaves the service in accordance with this clause, Naturally Jek Photography will not be liable to refund any amount to the Client, but may provide the Client with photographs taken by Naturally Jek Photography prior to Naturally Jek Photography leaving the service. 14. ATTENDANCE In the unlikely event Naturally Jek Photography is unable to complete the coverage due to unforeseen circumstances such as serious injury or death, Naturally Jek Photography will work together with the Client to find an alternative professional photographer to cover the Client’s wedding day. In the event that serious injury or death occurs and Naturally Jek Photography is unable to deliver on the agreed service, a full refund will be paid to the Client within twelve (12) months of the injury or death. 15. IMAGE STYLE & EDITING PROCESS The Client acknowledges that they are familiar with Naturally Jek Photography’s style, that Naturally Jek Photography’s work is continually evolving, that it is of a unique and artistic nature, that the photos taken may be different from those taken in the past and that Naturally Jek Photography will use its expertise and artistic judgement to create images consistent with its vision of the wedding, which may be different from the Client’s. Naturally Jek Photography’s editing encompasses cropping and colour grading of all selected images for the client in Lightroom. However, Naturally Jek Photography prices do not include advanced editing/retouching such as individual removal of pimples, scars, double chins or distracting elements. Additional editing may be requested and a fee per image will be quoted upon request and must be accepted prior to any work being carried out. Unless printing has occurred at Atkins Pro Lab (which is the only Australian based lab Naturally Jek Photography recommends for images to be printed in the very best quality), Naturally Jek Photography does not take responsibility for quality or colour issues. Printing labs and poor download/upload processes can heavily alter the quality of the image of which Naturally Jek Photography takes no responsibility for. 16. IMAGE USE (Optional) Naturally Jek Photography may use the photographs for advertising or otherwise promoting their work. This is optional and the Client must inform Naturally Jek Photography in writing prior to the wedding date if they do not wish to have their images used in any advertising or promoting. 17. IMAGE STORAGE AND CLIENT RESPONSIBILITY Naturally Jek Photography will provide a USB and online copy of the images. After providing these in full to the client Naturally Jek Photography is no longer required to store images. The Client’s online gallery will be live for twelve (12) months. It is encouraged to download these photographs into multiple places and take the uttermost care of the USB. After this time, if the Client loses their images and Naturally Jek Photography still has the images in storage, a re-upload fee of $300 will be charged if the Client requests Naturally Jek Photography re-upload the images. The Client should be aware that after Naturally Jek Photography provides the product in full, there is no obligation for Naturally Jek Photography to keep the images stored. 18. ALBUMS If an album is included in the wedding package, the Client has two (2) months from the provision of the photographs to select their images and four (4) weeks to review their online album once it is completed and ready for preview, before incurring additional charges in line with rising business costs. These additional charges will be at the sole discretion of Naturally Jek Photography and will be quoted at the time of incident. If an album is included in the wedding package, the album addition to your package will be voided and the album fee will not be refunded if the entire album process is not completed within twelve (12) months after the wedding date or if the Client has not chosen album images within nine (9) months after the wedding date. As Naturally Jek Photography retains Client images for only twelve (12) months, after this time Naturally Jek Photography will have no capacity send the Client’s images to the album designer. 19. DELIVERY Clients will be supplied with high-resolution JPEG files upon final delivery of USBs and online gallery. At no stage will RAW files be delivered. A sneak peak of the wedding will be uploaded to an online gallery within a week from the wedding date excluding public holidays. Final delivery of USB drives will be within six (6) weeks from the wedding date excluding public holidays and delivery times. 20. COPYRIGHT Naturally Jek Photography allows the Client to use the photographs for private, domestic and personal use only. Any sale or commercial use must have written approval by Naturally Jek Photography. Naturally Jek Photography asserts all rights attached to the photographs and the Client does NOT have the right to edit, change, add to, take from, alter or otherwise amend the photographs without the prior written consent of Naturally Jek Photography except in the case of cropping an image. The Client may submit images to their other vendors for social media use only or to “real weddings” sections of websites, magazines, and blogs, however, a credit to Naturally Jek Photography as the photographer must be given in the form of either a social media handle or direct website link. Naturally Jek Photography’s social media handle is @naturallyjek.photography and website link is http://www.naturallyjek.com 21. LOSS OR DAMAGE Naturally Jek Photography shall carry out the services with due and professional diligence. Elements that are beyond its control include interruption of the services due to guest photographers, faulty material, equipment failure or damage or loss of digital files. In the case of digital file loss prior to the delivery of USB and online gallery, Naturally Jek Photography and the Client agree that the liability of Naturally Jek Photography shall be limited to a full or partial refund of any money paid under this Contract as considered appropriate by Naturally Jek Photography in the circumstances, which shall be in full & final satisfaction of any damage or loss suffered. 22. PERFORMANCE The performance of this Contract is contingent upon acts of God, weather, flood, fire, warfare, government laws or regulations, electrical failure, equipment failure, strikes by suppliers, and/or any conditions beyond its control. 23. JURISDICTION This Contract is governed by and construed in accordance with the laws of Queensland. Actions, suits or proceedings relating in any way to this Contract or documents or dealings contemplated by it, may be instituted, heard and determined in a court of competent jurisdiction in Queensland. Each party irrevocably submits to the exclusive jurisdiction of such court for the purpose of any such action, suit or proceeding. 24. ENTIRE AGREEMENT connected with the subject matter of this Contract, and supersedes any prior understanding, arrangement, representation or agreements between the parties as to the subject matter contained in this agreement. 25. INDEMNITY The Client indemnities Naturally Jek Photography against any liability or loss arising from, and any costs and expenses arising our of, the performance or non-performance of the Client’s obligations under this Contract. 26. NOTICES The Naturally Jek Photography is not responsible for lost, delayed, or undelivered mail/emails. 27. COVID-19 In the event that the wedding cannot legally proceed on the wedding date due to government ordered lockdown, imposed restrictions and/or travel ban due to COVID-19, Naturally Jek Photography shall offer one (1) complimentary rescheduling as a gesture of goodwill which is subject to availability and must be rescheduled within twelve (12) months of the original wedding date. If the service entailed subcontractors which have been paid in full at the time of rescheduling, such as a second photographer, the rescheduling will be subject to their availability as well as the availability of Naturally Jek Photography. In the event that the original subcontractor is not booked for the rescheduled date and a substitute subcontractor is required, the Client will be charged a $200 fee to cover administration costs and the loss of service for the original subcontractor. Any additional COVID-19 related date changes after this first gesture of goodwill will be considered to be cancellation or rescheduling and will be processed accordingly pursuant to clause 5 or clause 6 above as the case may be. This complimentary rescheduling is not applicable to weddings that legally can go ahead with certain restrictions. If a wedding can legally go ahead on the original wedding date but is rescheduled by the Client, it will be considered by Naturally Jek Photography to be a standard rescheduling and will be processed accordingly pursuant to clause 6 above. In the event that Naturally Jek Photography is prevented from attending the venue due to government ordered lockdown, imposed restrictions, travel ban or mandatory vaccination requirements due to COVID-19, Naturally Jek Photography will work together with the Client to find an alternative professional photographer to cover the Client’s wedding day. It is the responsibility of the Client to make the necessary ongoing enquiries regarding possible COVID-19 requirements and restrictions and inform Naturally Jek Photography as soon as possible of any such requirements and restrictions. 28. REFUNDS Naturally Jek Photography will do its very best to support and accommodate the Client whose wedding date has been affected by COVID-19 or other circumstances. However, it must also protect the business and livelihood of its staff. For Naturally Jek Photography to remain in business it is not in a position to offer refunds. The Client acknowledges and agrees that in all cases the Client will not be entitled to a refund of any monies paid under this Contract, with the exception only of the extent provided for in clauses 14 and 21 above. The timeframe will include any hiking to location or travelling between preparation, ceremony, photography or intimate reception location. A customised timeframe will be created at the time of each booking and will be subject to the Musician and other team’s discretion. Call Me Will includes the offer to learn one additional personalised song per elopement if this is something desired. An entertainment form will be provided by the Musician for the couple to fill out. Completionand return is required no less than 21 days prior to the event. Price is inclusive of Call Me Will’s current set list and one additional son. Couples requesting personalised song lists are available at a additional custom quote to be arranged separately with Call Me Will. If custom song’s are requested within 21 days of the event, subject to viability, a rush fee will apply. WEATHER/SAFETY Access to power for gear will always be required, except for outdoor ceremonies. Foroutdoor ceremonies the Musician has a small battery powered PA and mixer that he can bring upon request and will be subject to location choices. If location allows for music to be connected to power, adequate protection and safety from weather is always required. It is at the discretion of the Musician to protect the equipment from weather and other hazards and if adequate protection is not available, he reserves the right withdraw his services on the day without loss of full payment. BOOKING FEE A $200 non-refundable retainer is required from time of booking. The Musician commits to being available to the Client on that date and shall make no other reservations for that date. By signing contract and making payment in full client accepts all terms andconditions for the agreed booking. EVENT CHANGES/CANCELATIONS If the date of the Event changes (due to any foreseen or unforeseen circumstance), the retainer will be kept by the Musician and the Musician will attempt to re book a new date subject to availability. If a suitable date is not found, then the Musician can offer a credit note for future performance within a 12 month period or a full refund at the discretion of the Musician. If the Client cancels the Event entirely, the Musician shall not be required to repay any of the payments made by the Client unless within the time duration from If the Musician is unable to attend Event (due to sickness, reasonable emergency, or other acts beyond the Musician’s’ control), the Musician shallendeavour to find a suitable replacement act. If no suitable replacement can be found, theMusician shall return all money paid by Client (including deposit), and this Agreement shall immediately terminate. LIMITATION OF LIABILITY Musician’s entire liability for any claim, loss, damage, or injury arising under or relating to this agreement is limited to the fees paid by Client for the services. In no event shall Musician be liable for special, incidental, consequential, or punitive damages, even if client informs the Musician of circumstances that would give rise to such damages. INDEMNIFICATION Musician shall not be held not responsible for the impact on the final product of any interference caused by guests, weather or other vendors at the Event. If the Musician is exposed to (i) unsafe conditions, or (ii) objectionable or illegalacts at the Event, the Musician reserves the right to take reasonable action to remedy such asituation, including but not limited to leaving the Event. In such event, Musician shall not beobligated to refund any fees paid by Client. ADDITIONAL COVID TERMS AND CONDITIONS The Adventure Elopement Team are able to offer one complimentary date change subject to availability of all vendors and to be rescheduled within 12 months of the original booking as a gesture of goodwill in the case of a Government based lockdown, imposed restrictions and/or travel ban prevents the wedding from going ahead. Any additional Covid 19 related changes after this first gesture of goodwill will fall under the above standard Terms and Conditions. This call needs to be made at a minimum 2 weeks prior to your elopement day before loosing the cost of wholesale prices for your florals.
